Welcome to HarborViewAtelier ("we," "us," or "our"). These Terms & Conditions ("Terms") are in place to regulate your interaction with our yacht charter services and web domain at harborviewatelier.sbs (the "Service"), which is managed by HarborViewAtelier.
Utilizing our Service, including charter booking, indicates your agreement with these Terms. Should you oppose any portion of these terms, you are not permitted to use the Service.
2. Service Overview
HarborViewAtelier offers high-end yacht charter services which cover an array of options such as:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private gatherings
- Multi-day charters
Our services are dependent on availability and meteorological conditions. We may alter or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Charter booking requires you to:
- Be 18 years or older
- Submit valid and comprehensive information
- Make a deposit as outlined in your booking confirmation
- Adhere to these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed only with payment received and our official confirmation. Service refusal remains at our discretion.
3.3 Availability
Charter availability hinges on vessel availability and favorable weather. Efforts will be made to accommodate your requested schedule.
4. Payment Terms
4.1 Pricing
All cost estimates are presented in € and cover taxes unless stated otherwise. Prices are variable and can change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter cost payable during booking
- Remaining Balance: Payable 48 hours prior to the charter's start
- Any extra fees (as applicable): Payable at the end of the charter
4.3 Payment Methods
We process payments through encrypted systems and accept major credit cards, bank transfers, and certified cheques.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before the start: Full reimbursement minus processing costs
- Between 24 to 72 hours before the start: 50% reimbursement
- Under 24 hours before the start: No reimbursement
5.2 Weather Cancellations
If our captain deems the weather conditions unsafe, we may:
- Reschedule your charter at no extra charge
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
Should your assigned vessel encounter mechanical issues, we'll strive to offer an acceptable substitute or issue a complete refund if a replacement is unavailable.
6. Safety and Conduct
6.1 Safety Requirements
All guests must comply with the following:
- Adhere to all instructions from the crew
- Use safety gear as directed
- Inform about any medical conditions impacting safety
- Stay within designated areas onboard
6.2 Prohibited Items
Passengers are not allowed to bring the following onboard:
- Glass containers
- Illegal substances
- Weapons of any kind
- Excessive non-alcoholic beverage (beyond reasonable consumption)
- Pets (without prior approval)
6.3 Conduct
Passengers are expected to behave in a civil manner. Disruptive or unsafe behavior grants us the right to curtail the charter without offering a refund.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is restricted to the charter fee you've paid, and does not cover:
- Personal injury from your negligence
- Personal belongings' loss or damage
- Indirect, incidental or punitive damages
- Delays under acts beyond our control, such as weather changes
7.2 Insurance Coverage
Our comprehensive marine insurance covers our fleet and operations. Passengers should arrange their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our charters means you're aware that such activities carry inherent risks, and you accept responsibility for your safety.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, paths, or timetables due to weather constraints, safety needs, or operational demands while ensuring similar alternatives.
9. Force Majeure
We cannot be held accountable for delays, cancellations, or alterations ensuing from unforeseeable events beyond our control, including but not restricted to:
- Adverse weather events
- Natural disasters
- Governmental orders
- Port shutdowns
- Equipment malfunctions
10. Privacy and Data Protection
Your private data is managed as per our Privacy Policy. By using our service, you consent to such data handling as outlined.
11. Intellectual Property
The content shown on our webpage, including texts, visuals, trademarks, and photos, is protected by copyright laws. Unauthorized reproduction or distribution is prohibited without our express authorization.
12. Governing Law
The applicable law in Spain governs these Terms. Any related disputes will be adjudicated in the courts within Barcelona, Spain.
